Dr. Paul clarifies marijuana bill on Kudlow—doesn’t “endorse” use

Groups like the Coalition for Medical Marijuana in New Jersey have been formed in a number of states. New Jersey's medical marijuana law was introduced by Democrats and Republicans. Dr. Ron Paul (R-Texas) clarified details on the marijuana bill he will introduce with Rep. Barney Frank (D-Mass.) and others. Paul talked to Larry Kudlow on CNBC’s The Kudlow Report on Wednesday. The bill is not a blanket legalization bill as numerous media have suggested.

Paul's position relates to the Tenth Amendment.

Paul said the bill would return marijuana to the status that existed in 1937. The legislation, he said, would remove it “from the jurisdiction of the federal government.” The states that chose to legalize it for personal use or for medical purposes would regulate marijuana in a manner similar to alcohol.

Kudlow noted the approach is a Tenth Amendment issue. The debate over marijuana has led some states where the herb is permitted for medical use to prohibit the use because of conflict with federal law.

AG McCollum to Fox: Mandate is ‘middle pole’ in Obamacare tent

Florida attorney general Bill McCollum told Fox News on Tuesday the individual mandate in the Patient Protection and Affordable Care Act is like the “pole in the middle of the tent.” If the mandate falls, the whole tent collapses. McCollum said that’s because “there’s no other funding mechanism.”

McCollum was one of the first to point out the vulnerability of the PPACA (commonly called ObamaCare) because of the lack of a severability clause in the bill.

As states fight Obamacare, supremacy clause misunderstood

Missouri voters have shot down the Obamacare mandate for individuals to buy health insurance, and other states have adopted various means of fighting the new law that is a legislative boondoggle. Speaker of the House Nancy Pelosi (D-Calif.) demonstrated the lack of logic in the poorly conceived bill most in Congress admitted they did not even read before passing.

Making her pitch to a group of supporters, Pelosi said, “But we have to pass the bill so that you can find out what is in it, away from the fog of the controversy.”

I get Chris Matthews-type shivers when I read a statement like that from the woman who leads the U.S. House.

At every turn when there is dissatisfaction from states about vague, poorly written federal legislation that can be extremely costly, media and statists cite the supremacy clause in the U.S. Constitution.

Nullification Summit to focus on states stopping unconstitutional laws

States’ rights are in the air, along with a renewed focus on the US Constitution, and The Tenth Amendment Center will hold a summit to inform the public how to “stop federal mandates at the state border.” The Florida Tenth Amendment Summit will be held in Orlando at the Omni Orlando Resort at Championsgate on 10-10-10—there’s a nice touch of marketing savvy in the selection of that date.

An announcement from TAC pointed out momentum in the states’ rights movement as Virginia, Utah, Idaho and others fight Obamacare. Occupying the top media narrative right now is Arizona’s effort to deal with the federal failure to stem the tide of undocumented aliens. Washington State, Oklahoma and Tennessee are fighting Capt-and-Trade legislation. Those are just a few efforts by the states; others are working to stop the Real I.D. Act and to protect gun rights.

Arizona sets up defense fund to help with federal lawsuit costs

Nino, US-CPB.]Arizona has set up a defense fund to help with costs of the federal lawsuit President Barack Obama’s administration has filed against the state. In an official announcement, Gov. Jan Brewer said proceeds from the fund will be used “to pay the substantial legal fees that Arizona has been, and will be, forced to incur as a result of all of these lawsuits.”

States are paying closer attention to the Tenth Amendment to the US Constitution.
